REMINDER TO TAKE ACTION TO COMPLY WITH ENHANCED VAPOR RECOVERY EQUIPMENT REQUIREMENTS BEFORE DECEMBER 23, 2024


WHO IS AFFECTED BY THIS ADVISORY?

Owners and operators of any gasoline dispensing facility (GDF) constructed in New Jersey before November 9, 2017. A GDF is any stationary facility that dispenses gasoline into the fuel tank of a motor vehicle, which makes it subject to New Jersey Air Pollution Control rules for gasoline transfer operations.


WHY IS DEP ISSUING THIS ADVISORY?

On December 23, 2017, the New Jersey Air Pollution Control rules (N.J.A.C. 7:27-16.3) were amended to include Enhanced Vapor Recovery (EVR) standards, established by California Air Resources Board (CARB), which aim to improve the effectiveness of gas pump vapor recovery systems, reduce vapor leaks from underground storage tanks, reduce evaporation from hoses and nozzles between use, redesign of nozzles to reduce drips, enhanced diagnostics to alert attendants when vapor recovery equipment malfunctions and improve the long-term reliability of vapor recovery equipment. The regulations were implemented in two phases. Phase II standards, which
primarily affected hoses and nozzles and the decommissioning of older gas pump vapor recovery systems, was completed in December 2020. Phase I standards, which primarily involve the tanks, piping, and fill ports, require that affected equipment be “CARB EVR-certified” on or before the deadline of December 23, 2024.

The revised fact sheet is located near the top of the website under the “News & Updates” and “Additional Resources” section.

A number of the questions / answers on the fact sheet were revised.

 

 

Please note: For Question 5, “What is the deadline to upgrade my Stage I Pre-EVR system to a Stage I EVR System?”, the answer to this question has been revised as follows:

 

5. What is the deadline to upgrade my Stage I Pre-EVR system to a Stage I EVR system?

GDFs that are exempt from installing Stage I EVR until the tanks are replaced
GDFs with existing gasoline tanks with “coaxial” Stage I systems are not required to upgrade to a Stage I EVR system until the existing gasoline tanks are removed and replaced with new gasoline tanks.

GDFs that must install Stage I EVR at installation
GDFs that install new gasoline tanks or a new Stage I system after January 2, 2015 must install a Stage I EVR system.

GDFs that must upgrade to Stage I EVR by January 2, 2022
GDFs with existing gasoline tanks with “dual-point” Stage I, and pre-EVR “screw-on” spill and vapor buckets,must install a Stage I EVR system by January 2, 2022.

GDFs that are not required to upgrade to Stage I EVR until after January 2, 2022
GDFs with existing gasoline tanks with “dual-point” Stage I, and Pre-EVR “slip-on” spill and vapor buckets, are not required to upgrade to a Stage I EVR system until the “Slip-on” spill or vapor buckets must be repaired or replaced, at which time StageI EVR spill and vapor buckets must be installed.

MassDEP Stage I Enforcement Discretion Directive: OPW 723V PV Vent Approval

The Massachusetts Department of Environmental Protection (MassDEP) is proposing to amend 310 CMR 7.24(3) Distribution of Motor Vehicle Fuel, to update the tables of Stage I systems certified by the California Air Resources Board (CARB) since January 2, 2015, the date the current Stage I regulation was last revised.

The existing regulations at 310 CMR 7.24(3) is part of the Massachusetts Ozone State Implementation Plan (SIP) and the regulatory amendments will be submitted to the U.S. Environmental Protection Agency (EPA) for approval into the SIP.  A public hearing will be held to receive comments on the proposed amendments on:

Testimony may be presented orally or in writing at the hearing. OPW 723VAttached is an Enforcement Discretion Directive, effective immediately, allowing the installation of Stage I enhanced vapor recovery (EVR) systems and components that are contained in California Air Resources Board (CARB) Orders issued since January 2, 2015 prior to the effective date of revisions to 310 CMR 7.24(3).

OPW Announces New FibreTite Multiport Spill Container

opw-fibretiteOPW has announced their new FibreTite Multiport Spill Containment System, which is now CARB EVR approved.  These containers are designed with a lightweight composite cover for long-term water tight performance and meet all CARB and EVR requirements, as well as being certified for use on all existing standard gasoline Phase 1 Vapor Recovery Certification Phase 1 EVR Executive Orders.  Among the features included are an integrated inspection port system, a removable flange in the container base, and a composite lift cover and optional levered plumber seal covers for easy access.

OPW UST EVR Training Certification Courses 2016

On October 26 and 27, OPW will be holding a pair of enhanced vapor recovery (EVR) training and certification courses in the Worcester, MA and Springfield, MA areas, respectively.  These courses, which are free to attend and require no experience, will allow attendees to install and service all OPW EVR Phase One System Components listed on the California Air Resources Board (CARB) Executive Order.  At the conclusion of the course, there will be a test which, if passed, will grant a 2-year certification.

New OPW 723V Pressure Vacuum Vent
